Welcome to Akspresso Marketing. These Terms and Conditions ("Terms") govern your use of our services, website, and all content provided by Akspresso Marketing ("we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must not use our services.

1. Services Provided

Akspresso Marketing offers email marketing, SMS marketing, campaign strategy, eCommerce optimization, and creative consulting services. Specific service deliverables, timelines, and pricing will be outlined in individual proposals or contracts agreed upon by both parties.

2. Client Responsibilities

Clients must:

• Provide accurate, timely, and complete information for project execution.
• Respond promptly to communications and approvals.
• Supply access to required platforms (e.g., Klaviyo, Shopify, website CMS) as needed.
• Ensure that all content provided is legally owned or properly licensed.

3. Payment Terms

• Payment terms, fees, and due dates will be specified in each proposal or invoice.
• Late payments may be subject to a late fee of 5% per month.
• We reserve the right to pause or terminate services for non-payment.

4. Intellectual Property

• Clients retain ownership of all original content and brand assets provided.
• Akspresso Marketing retains the right to showcase completed work in our portfolio unless a written NDA is in place.
• Any materials created by Akspresso that are not paid for in full remain the intellectual property of Akspresso Marketing.

5. Revisions and Approvals

• Projects include a set number of revisions (as outlined in your service package).
• Final approval of deliverables is required before launch or distribution.
• Additional revisions beyond scope may incur extra fees.

6. Confidentiality

We agree to keep all client information confidential and will not disclose or share proprietary or sensitive information without consent, unless required by law.

7. Cancellations and Termination

• Either party may terminate a project with written notice.
• If a client terminates mid-project, any completed work will be billed accordingly.
• Retainer clients must provide 30 days’ notice before cancellation.

8. Limitation of Liability

Akspresso Marketing is not liable for:

• Indirect, incidental, or consequential damages.
• Loss of revenue due to third-party tools/platforms malfunctioning.
• Errors resulting from inaccurate client-supplied information.

9. Third-Party Tools 

We may use third-party platforms (e.g., Klaviyo, Shopify, Canva, Photoshop). We are not responsible for any outages, changes, or failures on those platforms but will make every effort to resolve issues that impact deliverables.

10. Changes to Terms

Akspresso Marketing reserves the right to update these Terms at any time. Changes will be posted on our website. Continued use of services after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
